A tenant has been evicted after kicking her neighbor in the groin during a dispute over lawn mowing. The incident, which occurred in June 2024, was caught on CCTV and led the landlord to apply for her eviction.
The New Zealand Tenancy Tribunal heard that while the woman lashed out at her neighbor, the situation was not entirely one-sided. The two had a history of conflict, and both had been involved in offensive language and antagonistic behavior. Tribunal adjudicator Nicholas Blake noted that both parties had engaged in “bad mouthing” each other.
The conflict began when the neighbor, who occasionally mowed a strip of lawn between their homes, walked through a line of trees near the tenant’s property. He accused her of filming him and his children, a claim she denied. The confrontation escalated when he tried to knock her phone from her hand, and she kicked him in the groin in response. He also claimed she struck him in the face, though she denied this. The tenant testified that she acted in self-defense after he “lunged” at her but was unsure where she made contact on his body.
Both tenants had filmed each other during their time in the rental property.
